Terms of Service

Welcome to Ham Logger. By accessing or using our app, you agree to these Terms of Service("Terms"). If you do not agree, please do not use Ham Logger and uninstall the app.

1. Acceptance of Terms

By downloading, installing, or using Ham Logger, you confirm that you:

  • Are at least 13 years old (or meet the minimum age required in your country).
  • Agree to follow these Terms and our Privacy Policy.
  • Accept that violating these terms may result in suspension or termination of your access to the app, or any other action pursuant to law.

This agreement is solely between you and BioRust Studios, LLC("BioRust Studios," "we," "us," or "our"). Apple Inc. ("Apple") is not a party to this agreement and bears no responsibility for the app or its content.

2. License

Subject to your compliance with these Terms, BioRust Studios grants you a limited, non-exclusive, non-transferable license to use Ham Logger on any Apple-branded devices that you own or control, as permitted by the Apple App Store Terms of Service. This license does not allow you to use Ham Logger on any device that you do not own or control.

3. General Use

  • Logging Tool: Ham Logger is intended as a logbook tool for amateur radio operators to record and manage contact (QSO) information. It is not a substitute for official regulatory publications, station records required by law, or legal advice.
  • Lawful Use: You agree to use the app only for lawful purposes and in compliance with all applicable laws and regulations, including FCC rules and regulations governing amateur radio.
  • No Misuse: You agree not to misuse, reverse engineer, or attempt to exploit the app in any way.
  • Your Data: You are solely responsible for the accuracy of the log data you enter and for maintaining your own backups of your logbooks.

4. Purchases & Billing

  • In-App Purchases: Some features may require purchase. All pricing is displayed within the app prior to purchase.
  • Platform Billing:All purchases are processed through the platform you downloaded the app from — Google Play or the Apple App Store. By making a purchase, you also agree to that platform's terms of service and billing policies.
  • Google Play: Purchases made on Android are subject to the Google Play Terms of Service. You may request a refund through Google Play within the timeframe permitted by Google's refund policy.
  • Apple App Store: Purchases made on iOS are subject to the Apple Media Services Terms and Conditions. Refunds for App Store purchases are handled by Apple and may be requested at reportaproblem.apple.com. In the event of any failure of Ham Logger to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to Ham Logger.
  • Refund Requests (Google Play): If you purchased through Google Play, you may also request a refund directly from BioRust Studios by emailing bioruststudios+hamlogger@gmail.com. Refund requests are evaluated on a case-by-case basis and are not guaranteed outside of what is required by applicable law or platform policy. Apple App Store purchases can only be refunded through Apple.
  • Modifications: We may update pricing, features, or plans with prior notice.

5. Maintenance and Support

BioRust Studios is solely responsible for providing maintenance and support services for Ham Logger, as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to Ham Logger. For support, contact us at bioruststudios+hamlogger@gmail.com.

6. Content and Usage

  • Your Log Data: Logbook entries, ADIF imports/exports, and other content you enter or import into Ham Logger are your responsibility. You retain ownership of your data.
  • Accuracy: While we strive to provide reliable logging functionality, including features such as callsign lookup, gridsquare calculation, and statistics, we make no guarantees regarding the completeness or accuracy of any information generated, looked up, or calculated by the app. Always verify with official or authoritative sources where accuracy is critical.
  • Use at Your Own Risk: Ham Logger is provided as a logging and reference tool. You are solely responsible for ensuring your amateur radio operations and records comply with applicable regulations.
  • No Guarantee: We do not guarantee the accuracy, completeness, or suitability of the information provided for any particular purpose.

7. Limitation of Liability

Service Availability: We do not guarantee uninterrupted or error-free accessto Ham Logger. Ham Logger and its service is provided "as is" and "as available," without warranty of any kind. Without limiting this, we expressly disclaim all warranties, whether express, implied or statutory, regarding the app and the service including without limitation any warranty of merchantability, fitness for a particular purpose, title, security, accuracy and non-infringement. We are not liable for any loss of log data, including loss resulting from device failure, app errors, uninstallation, or failure to maintain backups.

8. Product Liability

BioRust Studios, LLC, not Apple, is responsible for addressing any claims by you or any third party relating to Ham Logger or your possession and/or use of Ham Logger, including but not limited to: (i) product liability claims; (ii) any claim that Ham Logger fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

9. Intellectual Property

In the event of any third-party claim that Ham Logger or your possession and use of Ham Logger infringes that third party's intellectual property rights, BioRust Studios, LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

10. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

You agree to comply with all applicable third-party terms of service when using Ham Logger (e.g., your wireless data service agreement).

11. Termination & Account Suspension

We reserve the right to suspend or terminate your access if:

  • You violate these Terms.
  • You engage in harmful, illegal, or disruptive behavior.
  • The app or its service is discontinued for any reason.
  • For any reason.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of Ham Logger after updates means you accept the new Terms.

13. Apple as Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
